What documentation is required for Residency application? 

The requirement of what is required keeps changing and you may be requested additional documentation as well but in general for each Residency permit type, you will need:

  1. Short Term Residency Permit

Usage of Photographs in Residence Permit Application 

It is mandatory to use biometric (in ICAO standards) photographs in residence permit documents.

In order to avoid any problems both in the application process on E-residence system and in transactions in the Provincial Directorates of Migration Management, it is important to pay attention to the conformity of the photograph in the said standard and submit the digital version of the photographs to the relevant persons during the application process if necessary.

Address Registration at Nufus 

Foreigners can no longer update their address at Nufus directly. They need to go to GOC idaresi to update their address

Process:

You can go to any GOC idaresi in your respective city and/or area

What to take:

  1. Passport
  2. Kimlik
  3. Rental Contract or copy of the title deed if you are the owner
  4. Utilities bill under your name

Who needs to go:

All adults PLUS kids above 18 years of age

If the address you are planning is currently vacant and not registered under anyone else’s name then you can update your address through the Nufus website online

How to get an e-devlet password?

Go to any PTT with your residency card and ask for a password. It will cost 2TL

Alternatively, you can log on to the e-devlet website using your Turkish bank account details

 

Connecting Utilities – Gas, Water & Electricity 

Visit the offices of each utility company

And you’ll need to take:

  1. A copy of the approved electrical project/project number (onaylı Elektrik projesi)
  2. A copy of the habitation certificate (iskan)
  3. Copies of the ownership documents for the property (title-deed/tapu, residence permit/ikametgah, rental lease/Kira kontratı etc.)
  4. A copy of your ID (Passport + Turkish ID number + Tax ID)
  5. DASK insurance certificate (compulsory earthquake insurance policy)
  6. Your subscription/installation number (can be found on your meter or a previous bill)

 

Touristic residency permits issued based on ownership of Property

You cannot get residency in any neighborhood that has more than 20% foreigners at the time of the application

Short terms residency permits can be issued for 12 or 24 months based on ownership of property

Can one get residency upon buying arsa, imarli arsa, or tarla?

The property being used for residency purposes needs to be a place of residence ready, habitable and suitable for the family to live in

Which type of residence permit can foreigners apply for private students, open education or distance education? 

Student residence permit is not allowed on the grounds of special student, open education or distance education.

You are required to apply for one of the residence permit which you meet the conditions

For rental based Residency permit applications, do we have to show a copy of the landlords tapu along with the notarised rental agreement?

Need to show:

  1. Rental contract notarized at a notary by the landlord
  2. Copy of the title deed (Tapu)
  3. Numarataj report
  4. DASK (Earthquake) insurance policy

 

Is it necessary to notify in case of a passport change?

Foreigners, who change their passport are required to notified to the governorship (Migration Management) within 20 working days

120 Day Rule: 

A residence permit may be cancelled if you spend more than 120 days outside Turkey

What can you do if your residency permit is rejected

If your application is rejected are given 10 days to leave the country.

You have the right to file a lawsuit against the rejection decision of your residence permit application.

This lawsuit is an action for the annulment of an administrative act.

If this lawsuit is concluded in your favor the rejection decision taken by the administration is cancelled.

The opening a lawsuit does NOT entitle the applicant to stay in the country after your residency permit has been rejected!

This is what some dishonest lawyers use to fool foreigners into believing that they are allowed to stay in the country indefinitely while the lawsuit is in progress.

Seeking Asylum

According to international law, in order to make an asylum application in any country, you need to have reached the borders of that country and present yourself to the authorities of that country.

You can not apply for asylum in Turkey, if you are not in Turkey

A person who was forced or compelled to flee their home country because of war, being persecuted on the account of race, religion, political opinion, nationality, membership to a particular social group or indiscriminate violence arising from a situation of international or domestic armed conflict or being subjected to the death penalty, torture, inhuman or degrading treatment, punishment or other and are therefore unable to go back to their home country, have the right to seek asylum in Turkey.

In order to seek asylum in Turkey, you have to approach the Directorate General for Migration Management (DGMM).

In order for stop criminals from being able to obtain Turkish citizenship:

A police criminal report, obtained in the last 6 months from country of nationality is now required as part of the documentation that needs to be submitted for the Type J residency permit (Citizenship Investor)

Goç idaresi guidelines related to Residency based on property ownership:

  1. All properties bought between 26 April 2022 and 16 October 2023, the rule of USD$75,000 / USD$50,000 depending on city sizes, still applies.

 

Valuation report (carried out by an independent government approved valuator) will still be required to be submitted as part of the residency permit application process

  1. Properties bought after 16 October 2023, the minimum value based on foreign currency exchange receipts as the declared value (ie: value on title deed) must be USD$200,000 irrespective of where the property is located

 

A valuation report is not required to be submitted as part of the residency permit application process

A valuation report will still be required for the title deed office.

There is no change to districts or neighborhood declared as being being closed for new applicants

Nöbetçi Noter 

Notary public offices are generally open from Monday to Friday from 8:30am to 5:00pm

Nöbetçi Noter” refers to a “Notary Public on duty” which is a  special service provided by notary offices during non-working hours, such as weekends and holidays.

The duty notary is available to perform urgent notarial services outside regular business hours, ensuring that essential legal transactions can be executed promptly when the regular notary offices are closed.

This service is particularly helpful for time-sensitive matters or situations that cannot wait until the next working day.
